The following Terms and Conditions relate only to Simply Be Perks members.

Terms & conditions for Perks

These terms and conditions (“Terms”) apply to the Simply Be Perks loyalty programme (“Simply Be Perks”) and set out how you can use and participate in Simply Be Perks, including signing-up, using your rewards and, should you want to, opting out.

References in these Terms to “us”, “we”, “our” or “Simply Be” means J D Williams & Company Limited (trading as Simply Be), a limited company registered in England and Wales (with company number: 00178367) with its registered office at: Griffin House, 40 Lever Street, Manchester M60 6ES, who operates Simply Be Perks.

References in these Terms to “you” or “your” mean you, as a registered Simply Be customer and participant in Simply Be Perks. If you sign-up to participate in Simply Be Perks online via your Simply Be customer account, you agree to be bound by and comply with these Terms.

Simply Be Perks is for your personal use only. We reserve the right (in our sole discretion) to terminate your membership to Simply Be Perks where we believe that you are misusing or abusing the programme in any way. If we terminate your membership we reserve the right (in our sole discretion) to revoke any rewards you have been (or may be) awarded and also to suspend or terminate your Simply Be customer account.

We may change, withdraw or cancel Simply Be Perks for any reason and at any time, without notice. We may also change these Terms at any time, but will notify you of any major changes (such notice may just be a note added at the top of these Terms). If you do not agree to the updated terms, you must stop using Simply Be Perks.

You may opt out of Simply Be Perks at any time via our app. Once we have processed your opt out: (i) you will no longer receive any communications from Simply Be Perks; (ii) you will not be awarded any new rewards; and (iii) any existing rewards will be removed from your Simply Be customer account. You may choose to opt back in at a later date but any rewards which were previously available will have been withdrawn.

To operate and manage your Simply Be Perks membership, we will use the information (including personal data) you provided to us when you registered for your Simply Be customer account. We may also use your customer account purchase history, so that we can offer rewards that are tailored to you. Please see our Privacy Policy for full details of how we manage your information, what we do with it, who we share it with and what your rights are.

These Terms apply in addition to our website Terms and Conditions and Privacy Policy as well as any applicable Delivery Terms.

Your rewards

To qualify for Simply Be Perks, you must be a Simply Be customer account holder, aged 18 years or over and be a UK resident. There are no “points” or “levels” in Simply Be Perks and it’s free to sign-up. We just want to reward all of our Simply Be customers for being great.

Once you have signed up for Simply Be Perks online via your Simply Be customer account, we will send you details of any free gifts, special offers and/or competition entries which are available to you. For a full list of all available rewards, visit Simply Be Perks via our app. Depending on the type of reward, you will be able to use them when purchasing items online at simplybe.co.uk or redeem them via the relevant third parties (as applicable), for example:

Partner Rewards: From time to time we may reward you with a voucher or discount code for a third party website or product. In order to redeem any such voucher code, you will need to visit the relevant third party (via their website or otherwise) and follow their instructions. It is your responsibility to manage any such rewards, including redeeming them before they expire and you will usually be required to accept the relevant third party’s terms and conditions and privacy policy.
Simply Be Rewards: From time to time we may reward you with special offers, for example free delivery or discount codes for orders from simplybe.co.uk. Details of any specific terms and conditions and/or restrictions (e.g. product restrictions) will be communicated to you with the reward. Any purchase from simplybe.co.uk will be subject to our Website Terms and Conditions as well as any applicable Delivery Terms.
Competitions and Prize Draws: From time to time we may reward you with entry into competitions and prize draws. These competitions and prize draws may be administered by us or by a third party. Each competition and prize draw will be subject to its own specific terms which will be made available to you before you agree to enter. These terms will include details of any third parties involved. By entering into a competition or prize draw, you agree to be bound by and comply with the applicable terms.

You will be able to view your chosen / active rewards in Simply Be Perks, via our app.

Point to be aware of

Insofar as is permitted by law, we will not in any circumstances be responsible or liable to compensate you or accept any liability for any loss, damage, personal injury or death occurring as a result of: using or accessing Simply Be Perks; or taking up any rewards, except where it is caused by our negligence or that of our employees. Your statutory rights are not affected.

You must keep your Simply Be customer account details (including any password) confidential and not disclose it to any third party. If you know or suspect that anyone other than you knows your username and/or password, you must let us know as soon as possible (see our Privacy Policy for contact details).

Any vouchers or discount codes provided as rewards are non-transferable, have no monetary value and cannot be exchanged for cash

This Terms & Conditions and Privacy Policy shall be governed by English law, and both you and us submit to the exclusive jurisdiction of the courts of England and Wales.

Your data and privacy

You will not be required to provide any additional information in order to sign-up for Simply Be Perks.

We will use the information (including personal data) you provided when you registered for your Simply Be customer account: (i) in accordance with our Privacy Policy; and (ii) in order to administer Simply Be Perks, for example:

Details of rewards that are available to you will be sent to the email address you provided when you registered for your Simply Be customer account.
Data from your Simply Be customer account may be used for the purposes of analysis and so that we can provide rewards that are tailored to you.
Data from your Simply Be customer account (including personal data) may be transferred to Antavo Limited (the company who provides our loyalty programme) so they can process your rewards.

It is important that the contact information on your Simply Be customer account is accurate and up to date at all times. If you need to amend any of your details, you can do this online via your Simply Be customer account.

If you have opted out of receiving email communications from Simply Be (when registering your Simply Be customer account or at any other time), your preferences will stay the same and you will not receive any emails in relation to Simply Be Perks either. You can still be a part of Simply Be Perks, you just won’t receive any email notifications about any new or existing rewards available to you. Your rewards will still be available when you log in to your Simply Be customer account online though.

Please note if you opt in, you may receive email communications relating to Simply Be Perks, but also non-specific marketing communications from Simply Be, in accordance with our Privacy Policy.
